Terms of Service

These Terms of Service ("Terms") govern the purchase and delivery of services offered by Ultimate NW Store LLC, doing business as Nelia Agency, registered in Kalispell, Montana, USA ("we", "us", "our"). By ordering any service listed on nelia.agency, you agree to these Terms.

1. Services

We provide web development, mobile application development, UI/UX design, branding, SEO/marketing and custom SaaS development services. The exact scope of each project is defined in a written proposal or quote sent to you before work begins.

2. Quotes and pricing

• Prices listed on the website are starting prices in euros (EUR); the final price is confirmed in your written quote.
• Quotes are valid for 30 days from the date of issue.
• Plans marked "starting" may increase based on project complexity, always agreed in writing before work begins.

3. Payment

• Payments are made by bank transfer (SEPA via Wise, wire via Mercury) or Wise payment link, using the payment reference provided at checkout.
• Projects above €1,000 are split: 50% deposit to start, 50% before final delivery, unless agreed otherwise.
• Consulting calls (€25) are payable in advance and credited toward your project if you hire us within 30 days.

4. Revisions and acceptance

Each project includes the number of revision rounds stated in your quote. Deliverables are considered accepted 14 days after delivery if no written feedback is received.

5. Refunds

Deposits cover work already scheduled and started, and are non-refundable once production has begun. If we fail to deliver the agreed scope, you are entitled to a proportional refund of the undelivered part.

6. Intellectual property

Upon full payment, you own the final deliverables produced specifically for your project (designs, code, brand assets). We retain the right to display the work in our portfolio unless you request otherwise in writing.

7. Client responsibilities

You are responsible for providing timely feedback, content and access needed to complete the project, and you warrant that materials you supply do not infringe third-party rights.

8. Limitation of liability

Our total liability for any claim related to a project is limited to the amount you paid for that project. We are not liable for indirect damages such as lost profits or data loss caused by third-party services.

9. Support

Each project includes 30 days of free post-launch support covering bug fixes within the delivered scope. Extended support and maintenance can be arranged separately.

10. Governing law

These Terms are governed by the laws of the State of Montana, USA. Any dispute will first be addressed in good faith negotiation; failing that, it will be submitted to the competent courts of Montana.
